Welcome to Pharmatia ("we", "us", or "our"). These Terms and Conditions ("Terms") govern your use of our website, mobile application, and pharmacy delivery services. By accessing or using our services, you agree to be bound by these Terms as per the provisions of the Information Technology Act, 2000 and Consumer Protection Act, 2019.
"Services" means pharmacy delivery services provided through our platform. "User" or "Customer" means any individual accessing or using our services. "Platform" means our website and mobile application. "Pharmacy" means licensed pharmacies partnered with us.
Pharmatia provides licensed pharmacy delivery services for medicines and healthcare products within Kerala and authorized areas. We facilitate the delivery of prescription and over-the-counter medicines from licensed pharmacies to customers' doorsteps, subject to all applicable laws including the Drugs and Cosmetics Act, 1940.
Users must be 18 years or older and legally competent to enter contracts. You must provide accurate prescription information, delivery details, and personal information. You are responsible for maintaining the confidentiality of your account and for all activities under your account. Misuse of the service or provision of false information may result in service termination and legal action under applicable Indian laws.
All prescription medicines require a valid prescription from a registered medical practitioner as per the Drugs and Cosmetics Act, 1940 and Rules, 1945. We reserve the right to verify prescriptions with the prescribing physician. Schedule H, H1, and other controlled drugs require additional verification. We do not dispense medicines without valid prescriptions.
Orders are subject to availability, prescription validity, and acceptance by our partnered pharmacies. We reserve the right to refuse or cancel orders for reasons including but not limited to prescription validity, product availability, pricing errors, or regulatory requirements. Order confirmation does not guarantee delivery if prescription verification fails.
All prices are inclusive of applicable taxes (GST) as per Indian tax laws. Prices may change without notice. Payment must be made through approved methods including Razorpay. We comply with PCI DSS standards for payment security. Failed payments may incur gateway charges. Refunds will be processed as per our refund policy.
Delivery timelines are estimates and not guaranteed. We deliver within Kerala and authorized areas. Delivery charges apply as disclosed. We make reasonable efforts for timely delivery but are not liable for delays due to force majeure, traffic, weather, or regulatory requirements.
All medicines are sourced from licensed pharmacies and stored as per Drugs and Cosmetics Act requirements. We maintain cold chain for temperature-sensitive medicines. However, we are not liable for any adverse reactions or side effects. Consult your physician for medical advice.
As per Consumer Protection Act, 2019, you have rights to safe products, correct information, and grievance redressal. For complaints, contact our grievance officer within 45 days. We will resolve grievances within the timelines prescribed by law.
Our liability is limited to the order value as per Consumer Protection Act, 2019. We are not liable for indirect, incidental, or consequential damages. We are not responsible for medical outcomes or advice. Our services are not substitutes for professional medical care.
All content on our platform including logos, text, and software is protected under Copyright Act, 1957 and other applicable laws. Unauthorized use is prohibited.
Your personal data is protected under Information Technology Act, 2000 and our Privacy Policy. We collect and process data only for service provision and comply with reasonable security practices.
We are not liable for delays or failures due to force majeure events including natural disasters, government restrictions, pandemics, strikes, or other events beyond our reasonable control.
We may terminate or suspend your access to our services immediately for violations of these terms or applicable laws, without prior notice.
Disputes will be resolved amicably first. If unresolved, they shall be subject to the exclusive jurisdiction of courts in Kerala, India. We encourage resolution through Consumer Courts as per Consumer Protection Act, 2019.
These Terms are governed by the laws of India, including but not limited to Consumer Protection Act, 2019, Information Technology Act, 2000, Drugs and Cosmetics Act, 1940, and Contract Act, 1872.
We reserve the right to modify these Terms at any time. Changes will be notified through our platform. Continued use constitutes acceptance of modified terms.
If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall continue in full force and effect.
